52.232-18 Availability of Funds FUNDS ARE NOT PRESENTLY AVAIBLE FOR THIS CONTRACT. THE GOVERNMENT'S OBLIGATION UNDER THIS CONTRACT IS CONTINGENT UPON THE AVAILABILITY OF APPROPRIATED FUNDS FROM WHICH PAYMENT FOR CONTRACT PURPOSES CAN BE MADE. NO LEGAL LIABILITY ON THE PART OF THE GOVERNMENT FOR ANY PAYMENT MAY ARISE UNTIL FUNDS ARE MADE AVAILABLE TO THE CONTRACTING OFFICER FOR THIS CONTRACT AND UNTIL THE CONTRACTOR RECEIVES NOTICE OF SUCH AVAILBILITY, TO BE CONFIRMED IN WRITING BY THE CONTRACTING OFFICER. This is a combined pre-solicitation/solicitation for commercial service prepared in accordance with the format in RFO Part 12, following RFO 12.201-1 Simplified Procedures, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested. An award, if any, will be made to the responsible offeror who submits a quote that (1) conforms to the requirements of the pre-solicitation/solicitation; (2) that receives a rating of "Acceptable" on the Technical Capability evaluation factor; (3) has a Past Performance of no negative FAPIS or CPARS or PPIRS; and (4) that submits the quote with the lowest total evaluated price (TEP), provided that the TEP is not unbalanced and is determined to be fair and reasonable. The Government reserves the right to award without discussions or to make no award at all depending upon (1) the quality of quotes received and (2) whether proposed prices are determined to be fair and reasonable. 1. This combined pre-solicitation/solicitation is being issued as a Total Small Business set-aside, and the associated NAICS code is 611692 - Automobile Driving Schools, Small Business Size Standard $10M. 4. Offeror's shall provide a completed Price List (see "Attachment 2 - Price List"). 5. Offeror's shall provide a completed Past Performance List of References (see "Attachment 3 - Past Performance list of References"). Offeror's without a record of past performance will not be evaluated favorably or unfavorably on past performance. A strong record of relevant past performance may be considered more advantageous to the Government.
